SANTAMARINA Y STETA’s IP area handles matters involving the protection and defense of our client’s intangible property, including patents, utility models, industrial designs, trademarks, slogans, trade names, copyrights, transfer of technology, plant varieties (breeder certificates), trade secrets, domain names and other related rights.

Our services include preparing and filing all types of applications for protecting intellectual property rights, as well as follow-up in monitoring of applications during any prosecution period until the protection has been granted. Once we obtain that protection, we assist the client with monitoring and maintenance services for preserving and, where appropriate, extending intellectual property protection.

If a client requires assistance in an IP dispute, we can handle the preparation and prosecution of infringement actions, cancellation actions and non-use cancellation actions. The client may relay upon our experience in handling IP claims before federal administrative courts, as well as constitutional writs of amparo review. If a client requires advice or representation in an IP matter that may involve litigation, the client’s counsel may confer with colleagues within the firm who specialize in civil, tax, and administrative litigation.

Our IP group includes lawyers who are members of IP professional associations, including the Association Internationale pour la Protection de la Propriété Intellectuelle (AIPPI), the International Trademark Association (INTA), Interamerican Intellectual Property Association (ASIPI), the Fédération Internationale des Conseils en Propriété Intellectuelle (FICPI), and the Mexican Association for Intellectual Property Protection (Asociación Mexicana para la Protección de Propiedad Industrial or AMPPI). Additionally, SANTAMARINA Y STETA has contacts in law firms located in most of the countries of the world, including countries that are members of the Paris Convention for the Protection of Industrial Property Rights and the Patent Cooperation Treaty, and particularly the United States of America, Europe, Asia and Latin America. These contacts help us to offer our clients world-wide, coordinated representation in IP matters.
